Not for emergencies
The website and online services are not for medical emergencies. If you believe you are experiencing a medical emergency, call 911 or seek emergency medical care immediately.
Eligibility and account responsibilities
You must be at least 18 years old, or the age of majority where you live, to use the services. You are responsible for providing accurate information, maintaining the security of your account credentials, and promptly updating information that changes.
Clinical review and prescriptions
Submission of an intake, refill request, or payment information does not guarantee that any product, medication, or service will be prescribed or provided. Licensed providers make independent clinical decisions based on the information available to them. A prescription, refill, or treatment plan is issued only when an independent licensed healthcare professional determines it is clinically appropriate.
Relationship with independent providers and pharmacies
CutisRx provides non-clinical website, e-commerce, subscription, customer support, and administrative platform services. Healthcare services are performed by independent healthcare professionals within a third-party telehealth provider network, and fulfillment and pharmacy services are performed by independent licensed pharmacies or fulfillment partners.
CutisRx is separate from those providers, networks, pharmacies, and fulfillment partners and is not responsible for their independent clinical judgment, prescribing decisions, pharmacy operations, communications, or omissions.
Relationship With Independent Providers and Pharmacies
CutisRx operates as a technology and administrative platform that connects users with a separate third-party telehealth provider network and independent licensed pharmacies when appropriate. CutisRx does not practice medicine, diagnose, prescribe, dispense medication, or control clinical decision-making.
All clinical evaluations, prescribing decisions, treatment determinations, medication selection, and pharmacy fulfillment decisions are performed independently by licensed professionals outside of CutisRx. Use of the CutisRx platform does not guarantee that any user will receive a prescription, medication, refill, or specific treatment.
Section: Nature of Services and Medical Disclaimer
A. Platform Function Only: Cutis RX provides a digital platform, marketplace, and pathway connecting consumers with independent, third-party medical networks and fulfillment options. You acknowledge and agree that Cutis RX is not a healthcare provider, does not offer medical advice, and does not practice medicine.
B. Independent Medical Judgment: Any healthcare provider you interact with through the independent telehealth network is solely responsible for their clinical services, medical evaluations, and compliance with state medical board regulations. Cutis RX exercises no control over, and assumes no liability for, the independent medical judgment, actions, or omissions of any third-party healthcare professional or network.
C. No Pharmacy Ownership: Cutis RX does not compound, dispense, or ship prescription products. All fulfillment and pharmacy services are handled entirely by independent, licensed third-party pharmacies.
Telehealth consent, privacy, and HIPAA
If you request access to telehealth services, you must review and agree to the Telehealth Consent. Our Privacy Policy explains how personal information is collected, used, and disclosed. Where protected health information is involved, the applicable privacy practices are described in the HIPAA Notice.
Payments, subscriptions, renewals, and fulfillment
You agree to pay all applicable charges presented at checkout. Certain products are offered as recurring subscriptions. By completing an order for a subscription product, you authorizeCutisRx to automatically charge your payment method on file in the amount and billing interval shown at checkout until you cancel.
You may cancel your subscription through your patient portal or by emailing noreply@cutisrxskincare.com at least 48 hours before your next billing date. Refund eligibility, shipping, returns, and fulfillment issues are described in our Refund, Cancellation & Return Policy.
Acceptable use
You may not misuse the website, interfere with its operation, attempt unauthorized access, submit false or misleading information, copy content for commercial use without permission, or use the services in violation of applicable law.
Intellectual property
The website, content, design, trademarks, software, and related materials are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable right to use the website for personal, lawful purposes.
Third-party services
The services may rely on third-party providers, including payment processors, pharmacies, analytics tools, communications vendors, fulfillment partners, and clinical or operational partners. Their own terms, consent forms, notices, and privacy practices may apply.
Disclaimers and limitation of liability
The website is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties not expressly stated here and are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the website or services.
Changes to these terms
We may update these terms from time to time. Updates are effective when posted unless a later effective date is stated. Your continued use of the website or services after an update means you accept the updated terms.
